8.0 ECTS creditsThe course treats family and succession law in a civil law perspective and comprises three areas: 1) child and parental rights, 2) marriage and cohabitation, and 3) inheritance and will.
In terms of children and parents legal rights, the focus is on children's rights and includes their rights to a name and information of their origin, legal parenthood and issues of guardianship, residence, and visitation.
The second area covers the legal aspects of marriage and divorce. The legal consequences of marriage are treated such as alimony, right to marital property, and inheritance. In the area of right to marital property and estate division, a study of a married couple's property ownership in marriage is made and the provisions pertaining to division of estate are investigated and applied in the dissolution of marriage and during the marriage. Regarding cohabitation, the issues of entering into cohabitation and its dissolution, cohabitant property rights, and the property involved in cohabitation estate division are investigated. Exercises include applying rules pertaining to estate division between spouses and cohabitants.
Regarding rights of succession, the prerequisites and basic principles of rights to inheritance, succession and secondary inheritance such as the legal inheritance succession, inheritance classes, reserved portion, and the scope of surviving spouse's rights and will.
